II. DATA COLLECTED WITHIN OUR WEBSITE

  1. Within the framework of our website, we collect personal data for the purposes of enabling the use of our website and its correct display, optimizing and improving it, ensuring security, remembering the user’s settings and customizing the website, as well as for maintaining the session. For this purpose, we process the following data that characterizes how the customer uses the electronically provided service (usage data):
  1. signs identifying the recipient of the service;
  2. signs identifying the end of the telecommunications network or data communications system used by the recipient of the service;
  3. information about the beginning, end and scope of each use of the electronically provided service;
  4. information on the use of electronically provided services by the recipient.
  1. We process data on the basis of our legitimate interest, which is to enable the functioning of our website and improve its performance.
  2. Personal data are processed for the period of time set by the user in the settings of the browser he or she uses.
  3. Providing data is voluntary, and through the cookie settings of the web browser used, you can limit the scope of personal data provided.

III. DATA COLLECTED FOR THE PURPOSE OF SENDING OUR NEWSLETTER

  1. For marketing purposes, including the purpose of sending the Eneftigo newsletter, we process the following personal data: name, surname, nickname, e-mail address.   
  2. The basis for the processing of personal data is the consent of the data subject. 
  3. The data will be stored by Eneftigo for the duration of the consent (until it is withdrawn).
  4. Providing data is voluntary, but is a condition for receiving the newsletter.

IV. DATA COLLECTED FOR CONTACT PURPOSES

  1. For the purpose of contacting users of our site, as well as potential contractors and customers, we process the following data: name, surname, address, contact details (phone, e-mail address), official position, other data included in e-mails or given in the contact form. 
  2. The data will be processed by us for purposes related to Eneftigo’s business, i.e. to answer questions asked by users, based on their consent given by sending us a question, as well as for the purpose of acquiring customers and contractors and contacting customers and contractors, which is a legitimate interest of the data controller. 
  3. Data processed for the purpose of responding to users’ questions will be stored by us for the period of time necessary to complete the communication in connection with the submitted question. Data processed for the purpose of contacting clients and customers will be processed for the duration of conducting business by Eneftigo.
  4. The data was obtained directly from the data subject, from publicly available sources or from Eneftigo customers and contractors, including potential customers and contractors of Eneftigo. 
  5. When a user sends us a question, providing data is voluntary, but it is necessary in order to receive an answer to the question asked.

V. PROTECTION AGAINST CLAIMS

Personal data collected by us in the course of all other processes described in this Privacy Policy may also be processed by us in order to assert our claims and to determine liability in accordance with the law. In such case, the basis for the processing is our legitimate interest, which is to assert and defend against third-party claims. Data for this purpose may be stored for a period of 6 years from the end of the year in which it was collected.

VI. PROVISIONS COMMON TO ALL PROCESSING PROCESSES

  1. In any processing of personal data, we comply with applicable laws.
  2. The person to whom the data relates (data subject) has the right to request from us access to, rectification, deletion or restriction of processing of personal data concerning him or her.
  3. In the case of data processing as part of the processes referred to in Parts II, IV and V of this Privacy Policy on the basis of a legitimate interest of the controller, the data subject has the right to object to the processing.
  4. In the case of processing under the processes referred to in Parts III and IV of this Privacy Policy on the basis of the data subject’s consent, the data subject shall have the right to withdraw consent at any time of consent to processing without affecting the legality of the processing carried out on the basis of consent before its withdrawal. 
  5. In any case, the data subject also has the right to file a complaint with the supervisory authority.
  6. Recipients of personal data may be our employees and associates, the IT company serving us, entities providing legal, accounting or human resources services to us, banks serving Eneftigo, our software and Internet service providers. In connection with the above, it is possible that data will be transferred to a third country. In this case, we will ensure that the transfer will take place to a country that, in accordance with the position of the European Commission, provides an adequate level of protection, or the entity to which the data are transferred will provide adequate safeguards, enforceable rights of data subjects and effective legal remedies, including in particular by entering into an agreement with the entity to which the data are transferred containing standard data protection clauses. 
  7. Exercising the rights of the data subject can be done by submitting a request using the contact information provided in Section I of this Privacy Policy.
  8. We strive to ensure that the request is handled within 30 days from receiving the request.
  9. We use adequate security measures to ensure appropriate protection of personal data.
  10. We apply the rules under the law to ensure the exercise of the rights of the data subject, and we have familiarized our employees and associates with them.

COOKIE POLICY 

The owner of the www.eneftigo.com service (hereinafter referred to as the “Service”) is Eneftigo Spółka z ograniczoną odpowiedzialnością with its registered seat in Warsaw, Wilhelm Konrad Roentgen 46/42, 02-781 Warsaw, registered in the Register of Entrepreneurs of the National Court Register by the District Court for the capital city of Warsaw in Warsaw, XIII Commercial Department of the National Court Register (KRS) under the number 0000998888, NIP 9512553304, initial capital in the amount of PLN 5,500.

The Service uses cookies, small text files containing computer data. Cookies are saved by the Service via a web browser on the final device (computer, tablet, smartphone) of the Service user.

The cookies used by the Service are safe for the users of the Service. It is not possible for viruses or other malware to get through them to users’ terminal equipment. These files do not in any way identify the personal data of the Service’s users, nor are they harmful to the users’ terminal equipment, nor do they cause configuration changes in the users’ terminal equipment or in the software installed on such equipment.

  • in the main application window, select: “Tools”, then “Internet options” and “Privacy”,

  • click the “OK” button.

b) Google Chrome:

  • in the main browser window (upper right corner), click on the “Google Chrome Settings” icon,
  • select the “Settings” tab, and then “Show advanced settings.”
  • in the Privacy section, we click on Content Settings. Under Cookies, check the “Block cookies and data from third-party sites” option,
  • finally, we select the button: “Done”.

c) Mozilla Firefox:

  • in the main program window, click on “Tools”, then: “Internet Options” and “Privacy”,
  • select “Firefox will use user settings”, the first item “Always use private mode” and the last item “Accept cookies” must be unchecked ( that is, there must be a empty checkbox next to them),
  • click the “OK” button

d) Opera:

  • in the browser menu, click on “Settings,” “Preferences,” “Advanced”.
  • in the “Advanced” tab, click on “Cookies”,
  • check the option “Never accept cookies”,
  • click the “OK” button.

e) Safari:

  • In the Safari drop-down menu, select “Preferences” and click the “Security” icon,
  • then select the security level in the “Accept cookies” area.
